| dc.description.abstract | El objetivo de este artículo es analizar los aspectos principales de las bases éticas del derecho según Santo Tomás de Aquino. Entre las contribuciones de Santo Tomás a la filosofía del derecho debemos mencionar su amplia reflexión sobre el derecho natural (ius naturale) en cuanto basado sobre la ley eterna y la sabiduría de Dios. En términos generales, el derecho natural puede ser definido como un sistema de normas que son inherentes a los seres humanos y preexisten a las normas sancionadas por el Estado. En la visión del Aquinate, las leyes positivas pueden volverse obligatorias gracias a su vinculación con el derecho natural. Al mismo tiempo, esta relación garantiza plenamente el más alto respeto de la dignidad humana. En esta perspectiva, cada uno adquiere una condición inviolable de libertad debido a su filiación con Dios. | |
| dc.description.abstract | The aim of this article is to analyze the main aspects of the ethical foundations of law according to Saint Thomas Aquinas. Among the contributions of Saint Thomas to the philosophy of law we must mention his wide reflection on natural law (ius naturale) as based on the eternal law and God’s wisdom. In general terms, natural law may be defined as a system of rules that are inherent in human beings and preexist to the rules issued by the State. In the vision of Aquinas, human-made laws may become compulsory thanks to their connection with natural law. At the same time, this relationship fully guarantees the highest respect for human dignity. In this perspective, everybody acquires an inviolable condition of freedom due to the filiation with God. | |
